As a user of this site, you agree that you individually and the organisation you represent are bound by these terms if you use our Site or any any information taken from our site. Violations and Additional Terms The Instillery Group Limited reserves the right to seek all remedies available at law and in equity for violations of this Terms and Conditions statement, including suspending or blocking your access to the Site.

No Waiver No delay or failure by The Instillery to enforce any of these Terms and Conditions shall constitute a waiver of any of our rights under these Terms and Conditions. Neither the receipt of any funds by The Instillery nor the reliance of any person on our actions shall be deemed to constitute a waiver of any part of these Terms and Conditions. Only a specific, written waiver signed by an authorised executive representative of The Instillery shall have any legal effect.

Severability If any clause or provision set forth in this Terms and Conditions statement is determined to be illegal, invalid or unenforceable under present or future law, the clause or provision shall be deemed to be deleted without affecting the enforceability of all remaining clauses or provisions.

Governing Law and Jurisdiction These Terms and Conditions and any disputes arising under or related to these Terms and Conditions and/or the Privacy Policy or to this Site will be governed by New Zealand & Australian Law. You agree to submit to the personal jurisdiction and venue of the courts of this region for any legal proceeding involving the Site, regardless of who initiated the proceeding. This English-language Terms and Conditions statement is The Instillery's official agreement with users of this Site. In case of any inconsistency between this English-language Terms and Conditions statement and its translation into another language, this English-language document shall control.

Return Policy

Incorrect goods: If we supply you with the incorrect products and you notify us within 24 hours we will replace the products at no additional cost within 5 business days.

Defective goods: Products purchased from The Instillery are covered by the manufacturers warranty, which is provided directly by the manufacturer or the authorised distributor in Australia and or New Zealand. The Instillery will liaise with the manufacturer to assist with the exchange or repair process. The products must be shipped back at your own cost after obtaining approval from The Instillery. After approval, an RMA number will be issued and the return address will be supplied.

Dead on Arrival (DOA): Please notify The Instillery within 24 hours days from the date of delivery. If The Instillery is not notified of the DOA products within 24 hours days from the date of the delivery, the full purchase price shall be payable.

Change of mind / Incorrect products ordered: If you change your mind once a product is purchased or have ordered incorrect products for your requirement, The Instillery may consider the return of the products depending on the circumstances and the type of product. You must request approval from The Instillery to return the goods within 24 hours days of the delivery date in brand new condition. No refunds will be issued after 24 hours from the delivery date. The goods must be shipped back at your own cost after obtaining approval from The Instillery. After approval, an RMA number will be issued and the return address will be supplied. A minimum restocking and handling fee of 25% of the original purchase value of the products will be charged.

Returned items condition: If goods are not returned in brand new condition, including all the original box contents and packaging (unmarked and undamaged), the Instillery warehouse staff may retain the right not to accept the returned products, and may result in the RMA being cancelled, and returned at your cost.

Non Refundable Products: SaaS contracts, POS Terminals, Labels, Receipt consumables and Labour charges (including on-site support contracts) cannot be returned or refunded, unless it is DOA (Dead on Arrival), warranty defective, or damaged in transit.

Changes to this Agreement The Instillery Group Limited reserves the right, in its sole discretion, to modify, alter, or otherwise change this Agreement at any time. We will provide notice of such change on this web site. Please review the Terms of Use and/or Additional Terms periodically for changes. Your continued use of the TheInstillery.com/store web site constitutes your acceptance of an agreement to be bound by these changes without limitation, qualification or change. If at any time you determine that you do not accept these changes, you must stop using this web site.
